We provide a marketplace where owners (lessors) can list their items for rent, and users (lessees) can search, reserve, and pay for rentals. Kzmemorental.live acts solely as an intermediary and is not a party to any rental agreement between lessors and lessees.

We do not verify the accuracy, quality, or condition of listed items. All rental transactions are directly between the lessor and lessee. Kzmemorental.live is not responsible for any disputes, damages, or losses arising from such transactions.

3. User Accounts

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration. You must notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized access.

We reserve the right to suspend or terminate accounts that violate these terms, are used for fraudulent activities, or cause harm to our platform or other users.

4. Listings and Rental Process

Lessors may list items for rent by providing accurate descriptions, photos, pricing, and availability. All listings must comply with applicable laws in Kazakhstan. Prohibited items include illegal goods, weapons, hazardous materials, and items that infringe on intellectual property rights.

Lessees may browse listings and submit rental requests. Once a request is accepted by the lessor, a binding rental agreement is formed between the lessor and lessee. Kzmemorental.live facilitates payment processing but is not a party to the rental agreement.

Rental periods, fees, deposits, and terms are specified in each listing. Users are required to inspect items upon receipt and report any discrepancies immediately.

5. Payments and Fees

All payments are processed through third-party payment gateways. Fees include rental charges, service fees, security deposits, and any applicable taxes. Service fees are non-refundable unless otherwise stated.

Lessors agree to pay a commission to Kzmemorental.live for each successful rental. The commission percentage is disclosed during the listing process and may be updated periodically.

Security deposits are held by the platform during the rental period and are released upon satisfactory return of the item, subject to deductions for damages or late returns. Disputes regarding deposits will be resolved based on evidence provided by both parties.

All fees are quoted in Kazakhstani Tenge (KZT) unless otherwise indicated. Users are responsible for any bank or currency conversion fees.

6. User Responsibilities

As a user, you agree to:

Use the platform only for lawful purposes and in compliance with all applicable Kazakhstan laws.
Not impersonate any person or entity or misrepresent your affiliation.
Not upload malicious code, viruses, or harmful content.
Not interfere with the operation of the site, including hacking, scraping, or overloading our servers.
Not engage in fraudulent activities, including fake listings, payment scams, or chargeback abuse.
Respect the rights of others, including privacy and intellectual property rights.
Lessees must return rented items in the same condition as received, normal wear and tear excepted.
Lessors must accurately describe items and maintain them in safe, working condition.

7. Cancellation and Refund Policy

Cancellation policies are set by lessors and vary by listing. Users must review the cancellation terms before confirming a rental. Kzmemorental.live may process cancellations only as authorized by the lessor.

Refunds are subject to the lessor's policy. In cases of platform errors or fraudulent listings, we may issue partial or full refunds at our discretion. We are not responsible for disputes between users regarding cancellations or refunds.

No-shows or failure to return items on time may result in forfeiture of deposits and additional charges. Users acknowledge that late returns may incur daily penalties as specified in the rental agreement.

8. Limitation of Liability

Kzmemorental.live is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the platform, including lost profits, data loss, personal injury, or property damage. This limitation applies even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your use of the site shall not exceed the total fees paid by you to us in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Kzmemorental.live, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

Your use of the platform.
Your violation of these terms.
Your infringement of any third-party rights.
Your rental transactions, including any damage, loss, or injury caused by you.

We reserve the right to assume exclusive defense of any matter subject to indemnification, at your expense.

10. Intellectual Property

The content on Kzmemorental.live, including text, graphics, logos, images, software, and trademarks, is owned by us or our licensors and is protected by intellectual property laws of Kazakhstan and international treaties.

You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent. You may not use our trademarks, domain names, or branding in any misleading manner.

Users retain ownership of their content, but grant us a non-exclusive, royalty-free license to display and promote their listings on our platform.

11. Privacy and Data Protection

We collect, store, and process personal data in accordance with our Privacy Policy and the laws of Kazakhstan, including the Law on Personal Data Protection. By using our site, you consent to such processing.

We implement reasonable security measures to protect your data, but we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account information.

We may share your data with third parties as necessary to facilitate rentals, process payments, or comply with legal obligations. We do not sell your personal data to third parties for marketing purposes.

12. Dispute Resolution

Any disputes arising from these terms or your use of the platform shall be governed by the laws of the Republic of Kazakhstan. Exclusive jurisdiction lies in the courts of Almaty, Kazakhstan, unless applicable law requires otherwise.

Before initiating legal action, you agree to attempt informal resolution by contacting us at support@kzmemorental.live. We will make reasonable efforts to resolve your concerns within 30 days.

If informal resolution fails, disputes will be settled through binding arbitration in accordance with the rules of the Kazakhstan Arbitration Centre. The arbitration shall be conducted in Almaty and in the Russian or Kazakh language, at our discretion.

You waive any right to participate in class action lawsuits or collective arbitrations.

13. Termination

We may terminate or suspend your account and access to our services at any time, without prior notice, for conduct that we believe violates these terms or is harmful to other users or our platform.

Upon termination, your right to use the site ceases immediately. Any pending rental obligations must still be fulfilled. We are not liable for any damages resulting from termination.

Provisions that by their nature should survive termination, including warranties, indemnification, and dispute resolution, will remain in effect.

14. Third-Party Links

Our site may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party sites.

You acknowledge that we shall not be liable for any damages or losses caused by your use of such third-party services. We encourage you to review the terms and policies of any third-party site you visit.

15. Force Majeure

We shall not be liable for any failure to perform our obligations if such failure is caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, epidemics, government actions, or internet outages.

In such cases, our obligations will be suspended for the duration of the force majeure event. We will make reasonable efforts to notify you and resume services as soon as possible.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and Kzmemorental.live regarding your use of the platform. They supersede any prior agreements or understandings, whether written or oral.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right.

For users in Kazakhstan, these terms may be translated into Kazakh or Russian for convenience, but only the English version is legally binding.

19. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be effective immediately upon posting on this page. We will notify users of material changes via email or by a prominent notice on our website.
